First: The Legal Department is responsible for interpreting the financial provisions of applicable legislation, reviewing draft laws and regulations, and providing opinions and legal advice on matters related to civil service and financial issues submitted to the Ministry by state institutions and the socialist sector. It also prepares legal drafts for laws, regulations, and instructions related to the Ministry’s work.
Second: The department is headed by a Director General holding a university degree in law.
Third: The Legal Department consists of the following divisions:
1 – Rights Division:
This division interprets the provisions of laws, decisions, regulations, and instructions that do not fall under the jurisdiction of other divisions, and provides legal opinions and advice accordingly. It also drafts legal texts for laws, decisions, regulations, and instructions requested within its scope of competence. In addition, it represents and defends the rights of the public treasury before courts and competent authorities, enforces judgments issued in its favor through enforcement departments, and follows up on the collection of adjudicated amounts. It also provides opinions on cases concerning funds transferred to the state, seized assets, and related lawsuits, as well as reviewing all customs-related matters submitted to the Ministry and processing their transactions.
2 – Public Service Division:
Responsible for interpreting the provisions of laws, decisions, regulations, rules, and instructions related to civil service. It drafts legal texts for laws, decisions, regulations, and executive instructions connected with civil service, as requested, or provides opinions on them. It also gives opinions and advice on matters related to civil service and retirement issues of employees in state institutions and the socialist sector that are submitted to the Ministry. Additionally, it reviews objections involving appeals against decisions issued concerning pension rights, in line with applicable pension laws, and refers them to the Pension Cases Review Board and the relevant pension committees.
3 – Financial Affairs Division:
Handles the interpretation of financial provisions of laws, decisions, regulations, and instructions. It prepares legal drafts for laws, decisions, regulations, and executive instructions in financial matters as requested, and provides legal opinions and advice in this domain. It also processes transactions related to financial cases referred to the Ministry.
4 – Consultation Division:
This division is tasked with providing legal consultations and advisory opinions on matters submitted to the Ministry that do not fall within the specific scope of other divisions.
Fourth: Each of the above divisions is headed by a Director, who holds a university degree and possesses relevant expertise and specialization.
